Terms and Conditions of Supply
Please read these terms carefully before placing an order. These terms constitute a legally binding agreement between you (the "Customer") and Tooaleta (the "Supplier").

1.1. This website is operated by Tooaleta ("we", "us", "our"). Our principal place of business for legal correspondence regarding these terms is in Klagenfurt, Austria.

2. Contract Formation
2.1. The presentation of products on our website does not constitute a legally binding offer but a non-binding online catalogue (an "invitation to treat").
2.2. By clicking the final "Place Order" (or equivalent) button at the checkout, you are placing a binding offer to purchase the goods in your cart.
2.3. A binding contract is formed only when we accept your order. This acceptance occurs either by sending a distinct order confirmation email or by dispatching the goods. An initial automatic acknowledgement of receipt of your order does not constitute acceptance of the contract.
2.4. We reserve the right to refuse any order at our discretion prior to contract formation (e.g., due to stock issues, inability to obtain payment authorisation, or pricing errors).
2.5. We will retain a digital copy of the contract (your order details). You may request a copy via email.
3. Price and Payment Terms
3.1. Pricing Structure and VAT
3.1.1. UK & EU Consumers: For delivery destinations within the United Kingdom and the European Union, prices displayed include applicable Value Added Tax (VAT). No further taxes or duties are payable by you upon delivery (Incoterms: DDP - Delivered Duty Paid).
3.1.2. Rest of World & Exempt Regions (e.g., Channel Islands): For delivery destinations outside the UK/EU tax territories, UK/EU VAT will be deducted at checkout. You are the importer of record and are responsible for all local import duties, taxes, and administration fees levied by your customs authority (Incoterms: DAP - Delivered at Place). These are not included in our prices.
3.2. Payment Methods
3.2.1. Payment must be made in full at the time of ordering. We accept major credit and debit cards (Visa, MasterCard, American Express) processed securely via our payment partner, Stripe. Your card will be charged immediately upon order placement.
3.2.2. Transactions are subject to strong customer authentication measures (e.g., 3D Secure/Verified by Visa) to prevent fraud, in compliance with Payment Services Regulations.
3.2.3. Bank transfer is available upon request via Pro Forma invoice. Goods will only be allocated and dispatched upon receipt of cleared funds.
4. Delivery, Risk and International Customs
4.1. Delivery Costs and Times
4.1.1. Delivery costs are calculated at checkout based on weight and destination. Below is a summary indicating current rates:

4.1.2. Any delivery timescales quoted (e.g., "5 working days") are indicative estimates only. While we endeavor to meet these timescales, time for delivery shall not be of the essence of the contract.
4.2. Transfer of Risk and Inspection
4.2.1. For Consumer Sales (B2C): The risk of loss or damage to the goods passes to you when you (or a third party indicated by you, other than the carrier) acquire physical possession of the goods.
4.2.2. You must inspect the packaging upon arrival. If there is visible transit damage, you must note this on the carrier's delivery receipt and notify us immediately with photographic evidence.
4.3. Installation Warning
4.3.1. We strongly advise against booking plumbers, electricians, or other tradespeople until you have received your goods and inspected them for condition and completeness. We accept no liability for third-party costs or cancellation fees incurred due to delivery delays or damaged goods.
5. Consumer Cancellation Rights & Returns
This section applies to "Consumers" as defined by relevant consumer protection legislation (e.g., the UK Consumer Rights Act 2015). Business customers should contact us directly regarding returns.
5.1. The Right to Cancel (Cooling-off Period)
5.1.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (and equivalent EU directives), you have a statutory right to cancel your contract for any reason within 14 days of receiving the goods.
5.1.2. Our Enhanced Policy: We extend this period to 15 days from the day after you receive the goods.
5.1.3. To exercise this right, you must inform us of your decision to cancel by a clear statement (e.g., email to [email protected]) within this 15-day period.
5.2. Crucial Exclusion to Cancellation Rights (Hygiene)
IMPORTANT LEGAL EXCEPTION REGARDING HYGIENE PRODUCTS
5.2.1. Pursuant to Regulation 28(3)(a) of the Consumer Contracts Regulations 2013, the right to cancel does not apply to contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
5.2.2. This exclusion applies strictly to Electronic Bidet Seats, Non-Electric Attachments, and Handheld Sprays. If the sealed hygiene packaging on these items is opened, or if the unit has been installed or connected to water, it cannot be returned under the cancellation policy unless faulty.
5.3. Returns Procedure and Refunds
5.3.1. If you cancel this contract (for eligible non-hygiene items), you must return the goods to us without undue delay and in any event not later than 15 days from the day you communicate your cancellation. The deadline is met if you send back the goods before the period of 15 days has expired.
5.3.2. You will have to bear the direct cost of returning the goods unless the item was delivered in error or is faulty. We recommend using an insured, tracked service.
5.3.3. We may make a deduction from the refund for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you (handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods).
6. Warranty and Faulty Goods
6.1. Statutory Rights
6.1.1. We are under a legal duty to supply goods that are in conformity with this contract. Nothing in these terms will affect your legal rights as a consumer under the UK Consumer Rights Act 2015 (or equivalent local implementation of EU Directive 1999/44/EC), which requires goods to be of satisfactory quality, fit for purpose, and as described.
6.2. Manufacturer Warranty
6.2.1. In addition to your statutory rights, products are covered by a manufacturer's warranty. The standard warranty period is two (2) years from delivery for customers in the UK and EU.
6.2.2. This warranty covers material defects and manufacturing faults. It does not cover faults arising from: Improper installation not in accordance with instructions; normal wear and tear; limescale damage; improper use; or unauthorized modifications.
6.3. Extended Service Membership
6.3.1. Optional extended warranty memberships (adding 1, 3, or 5 years of defined coverage) are separate service contracts subject to the specific terms provided at the point of purchase.
7. Liability and Disclaimers
7.1. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
7.2. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
7.3. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
8. Data Protection and Security
8.1. We take your privacy seriously. We will only use your personal information as set out in our Privacy Policy, which aligns with the General Data Protection Regulation (GDPR) and the UK Data Protection Act 2018.
8.2. Our website uses industry-standard SSL (Secure Socket Layer) encryption technology to ensure that all personal and payment details submitted during the checkout process are secure.
9. Governing Law and Jurisdiction
9.1. These terms are governed by Austrian law.
9.2. Legal proceedings in respect of the products shall be brought in the courts of Klagenfurt, Austria.
9.3. Crucial Note for Consumers: If you are a consumer resident in the UK or another EU member state, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms, including the choice of Austrian law clause above, affects your rights as a consumer to rely on such mandatory local laws (e.g., the UK Consumer Rights Act).
